However, in order not to perpetuate the prohibited chayavei la’avim marriage, the rabbis forbid yibum and require chalitzah. Accordingly, in a situation where the marriage of the widow to the brother-in-law would fall into the category of chayavei la’avim, the widow cannot marry another man until she receives chalitzah from her surviving brother-in-law.
